OFFICIAL RULES GOVERNING DRAWING OF HOAG URGENT CARE COSTA MESA OPEN HOUSE SWEEPSTAKES
There will be a total of five (5) winners. By entering, you will have a chance to win one of the five (5) following prizes:

• $50 Gift Certificate for Finest Nails (one winner)
• $50 Gift Certificate for Juice It Up (one winner)
• $50 Gift Certificate for French’s Bakery (one winner)
NO PURCHASE NECESSARY TO ENTER OR WIN. You understand you are providing your contact information to Hoag Urgent Care, and such information will be used for the purposes of recording participation in the Sweepstakes and winner notification.
ELIGIBILITY: OPEN ONLY TO LEGAL RESIDENTS OF THE STATE OF CALIFORNIA WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF 4/1/2023. Employees, associates and contractors of Hoag Urgent Care, 2995 Redhill Avenue Suite 200, Costa Mesa CA 92626 USA (“Sponsor”), affiliate companies, and their immediate family (spouse, parents, siblings and children) or persons residing in the same household as they do are not eligible to participate or win. By participating, entrants agree to these Official Rules. Void outside the state of California and where prohibited, taxed or restricted by law. All federal, state and local laws and regulations apply.
PROMOTIONAL PERIOD: Hoag Urgent Care Costa Mesa Open House Sweepstakes (“Sweepstakes”) begins at 10:00:00 a.m. Pacific Time (PT) on 4/1/2023 and ends at 12:00:00 p.m. PT 4/1/2023 (the “Promotional Period”).
TO ENTER: There is one (1) way to enter the Sweepstakes: BY COMPLETING ENTRY FORM: To enter by ENTRY FORM, complete the entry form that is provided at the Hoag Urgent Care Costa Mesa Open House; available only on 4/1/2023. No other forms of entry or participation are valid. There is a limit of one (1) entry per adult during the Promotional Period. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different e-mail addresses, identities or any other methods may void that entrant’s entries and that entrant will be disqualified. Entries must be received by 12:00:00p.m. on 4/1/2023 by Sponsor to be eligible for the random drawing. No automated entry devices and/or programs permitted. All entries become the sole and exclusive property of the Sponsor. Receipt of entries will not be acknowledged and entries will not be returned.
RANDOM DRAWING: One (1) random drawing will take place on or about 2:00 p.m. on 4/1/2023 from all eligible entries received during the Promotional Period. No substitution, cash redemption or transfer of prize, but Sponsor reserves right to substitute prize of equal or greater value if advertised prize becomes unavailable for any reason. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges.
PRIZES/ODDS: Five (5) Prizes will be awarded. The Prizes consist of: (first draw) four (4) Disneyland Tier 5, one park tickets (one winner). Total Prize Approximate Retail Value (ARV): $676; (second draw) one (1) $50 Gift Certificate for Starbucks (one winner); (third draw) $50 Gift Certificate for Finest Nails (one winner), (fourth draw) $50 Gift Certificate for Juice It Up (one winner); (fifth draw) $50 Gift Certificate for French’s Bakery (one winner). Winners are responsible for all taxes and fees associated with prize receipt and/or use. The odds of winning depend upon the number of eligible entries received at the end of the Promotional Period; i.e., if 500 entries are received the odds of winning are 5:500.
PRIZE AWARD/NOTIFICATION: Potential Prize Winners will be contacted on or about 4/1/2023 by e-mail and/or phone at Sponsor’s sole discretion, and will be required to complete and return an Affidavit of Eligibility and a Liability/Publicity Release (“Affidavit”), (unless prohibited by law). The Affidavit must be returned within five (5) days of receipt of the document. In completing the Affidavit the potential winner will be required to provide his/her social security or tax ID number, which will be used solely for the purposes of Sponsor’s legal compliance in filing US Tax Form 1099. Ineligibility or non-compliance with any of these requirements or return of prize, prize notification and/or Affidavit as undeliverable will result in disqualification, and forfeiture of the prize, and the selection of an alternate winner through random drawing in the manner described above. Winner is not permitted to (a) replace the prize with another prize or item; (b) redeem the prize for cash; or (c) transfer or assign the prize to another person. All federal, state and local, and other taxes on prizes are the sole responsibility of the winner.
GENERAL CONDITIONS: Entrant agrees that Sponsor, its parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, agents, successors and assigns (collectively, “Sponsor Entities”) are released, will have no liability whatsoever for, and shall be held harmless by entrants, against any liability for any injuries, losses, damages, costs or expenses of any kind to person(s), including without limitation, personal injury and/or death, or property damage resulting in whole or in part, directly or indirectly, from entrant’s preparation for, travel to or participation in Sweepstakes, or acceptance, possession, misuse or use of the prize or participation in any Sweepstakes related activities and for claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Entrant acknowledges that he/she is familiar with the provisions of California Civil Code § 1542, which provides as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” Being aware of said code section, entrant hereby expressly waives any rights he/she may have thereunder, as well as any other statute or common law principles of similar effect. Entrant agrees that except where legally prohibited, winner grants permission to Sponsor, Sponsor Entities and those acting under their authority the right to the use of his/her name, address (city and state), picture, portrait, likeness, voice, biographical information and/or statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in any and all media now known or hereafter developed, worldwide, without notice, review or approval. The entry information provided on the Entry Form is subject to Sponsor’s Privacy Policy. To read that Policy, access the Sponsor’s Website at www.hoag.org, and then access the Privacy Policy.
LIABILITY LIMITATIONS: Neither Sponsor, nor Sponsor Entities are responsible for lost, late, misdirected, incomplete, or non-delivered entries. Persons who tamper with or abuse any aspect of this Sweepstakes or otherwise attempt to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives, as solely determined by the Sponsor, may be disqualified. Neither Sponsor, nor Sponsor Entities are responsible for any incorrect or inaccurate information, whether caused by entrants or others, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction. Sponsor reserves the right in its sole discretion to cancel, suspend or modify this Sweepstakes, in its entirety or in part, for any reason, including should tampering, unauthorized intervention, fraud, technical failures, or other causes corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes, or any part of it. In no event will Sponsor or Sponsor Entities be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.
CHOICE OF LAW: This Sweepstakes is governed by the laws of the United States and the State of California applicable to contracts made and performed in the State of California, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, Entrants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, exclusively before a court located in Newport Beach, California having jurisdiction and entrants irrevocably consent to the exclusive jurisdiction of the state and federal courts located in Newport Beach, California; and (2) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SPONSOR’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS SWEEPSTAKES, WHETHER IN CONTRACT OR TORT OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE STATED ARV OF THE PRIZES OFFERED HEREUNDER. In the event any provision of these Official Rules is held to be unenforceable, these Official Rules will continue in full force and effect without such provision. These Official Rules are intended to be the complete, final and exclusive statement of the terms of the agreement between each entrant and the Sponsor relating to the subject matter hereof.
